Neurophysiological studies in monkeys and neuroimaging studies in humans support a model of empathy according to which there exists a shared code between perception and production of emotion. The neural circuitry critical to this mechanism is composed of frontal and parietal areas matching the observation and execution of action, and interacting heavily with the superior temporal cortex. Further, this cortical system is linked to the limbic system by means of an anterior sector of the human insular lobe.

In the last decades it has become clear that medicine must find some way to combine its scientific and humanistic sides. In other words, an adequate notion of medicine requires an integrative position that mediates between the analytic-reductionist and the normative-holistic tendencies we find therein. This is especially important as these different styles of reasoning separate “illness” (something perceived and managed by the whole individual in concert with their environment) and “disease” (a “mechanical failure” of a biological element within the (...) body). While the demand for an integrative view has typically been motivated by ethical concerns, we claim that it is also motivated, perhaps even more fundamentally, by epistemological and methodological reasons. Evidence-based bio-medicine employs experimental and statistical techniques which eliminate important differences in the ways that conscious humans evaluate, live with, and react to disease and illness. However, it is precisely these experiences that underpin the concepts and norms of bio-medicine. Humanistic disciplines, on the other hand, have the resources to investigate these experiences in an intersubjectively testable way. Medicine, therefore, cannot afford to ignore its nature as a human science; it must be concerned not only with disease and illness, but also with the ways in which patients as persons respond to malady. Insofar as attitudes and expectations influence the criteria of illness and disease, they must be studied as part of the genuine subject matter of medicine as a human science. In general, we urge that this is a necessary step to overcome today's trend to split evidence-based and clinical medicine. (shrink)

In December 2017, Law 219/2017, ‘Provisions for informed consent and advance directives’, was approved in Italy. The law is the culmination of a year-long process and the subject of heated debate throughout Italian society. Contentious issues are addressed in the law. What emerges clearly are concepts such as quality of life, autonomy, and the right to accept or refuse any medical treatment – concepts that should be part of an optimal relationship between the patient and healthcare professionals. The law maximizes (...) the value of the patient’s time to decide. Every patient is allowed to make choices for the present as well as for the future, conceived as a continuation of the present, and to decide what comes next, based on what he/she already knows. The law identifies three distinct but converging paths towards the affirmation of a care relationship based on reciprocal trust and respect: the possibility to consent to or refuse treatment, the shared care planning, and advance directives. The fundamental point to emerge from the new Italian law is that consensus is an essential connotation of the treatment relationship. Consensus is not limited to the acceptance/rejection of medical treatment but is ongoing. It is projected into the future through shared care planning and advance directives which act as tools for self-determination and the manifestation of the beliefs and preferences of persons unable to express their will. These principles are in line with the idea of appropriate care as evaluated from two different perspectives, one of scientific adequacy and the other commensurate with the individual’s resources, fragility, values, and beliefs. Surely, however, the new law is not the end of the matter on issues such as conscientious objection, which is deeply rooted within the Italian cultural and political debate. In this regard, healthcare institutions and policymakers will be called upon to develop and implement organizational policies aimed at the management of foreseeable conscientious objection in this field. Il grande filosofo — quello che diventa un classico — è tale perché racconta storie e insieme fornisce gli strumenti per saggiarne la fondatezza e la (...) consistenza. Emanuele Severino appartiene ormai a pieno titolo ai classici della filosofia; il presente volume vuole essere una testimonianza di come le sue opere e i suoi insegnamenti continuino a far “partorire” idee nuove, riconoscendo nella filosofia severiniana un punto di partenza imprescindibile. We formulate and investigate experimentally a model of how individuals choose between time sequences of monetary outcomes. The model assumes that a decision maker uses, sequentially, two criteria to screen options. Each criterion only permits a decision between some pairs of options, while the other options are incomparable according to that criterion. When the first criterion is not decisive, the decision maker resorts to the second criterion to select an alternative. We find that: (1) traditional economic models based on discounting (...) alone cannot explain a significant (almost 30%) proportion of the data no matter how much variability in the discount functions is allowed; (2) our model, despite considering only a specific (exponential) form of discounting, can explain the data much better solely thanks to the use of the secondary criterion; (3) our model explains certain specific patterns in the choices of the “irrational” people. We reject the hypothesis that anomalous behavior is due simply to random “mistakes” around the basic predictions of discounting theories: deviations are not random and there are clear systematic patterns of association between “irrational” choices. However, these techniques were evaluated on a small multilingual corpus of directives and NIMs. In this paper, we utilize word and paragraph embedding models learned by shallow neural networks from a multilingual legal corpus of European directives and national legislation (...) to develop unsupervised semantic similarity systems to identify transpositions. We evaluate these models and compare their results with the previous unsupervised methods on a multilingual test corpus of 43 Directives and their corresponding NIMs. We also develop supervised machine learning models to identify transpositions and compare their performance with different feature sets. Why "System and Freedom"? Why "Rationality and Improvisation"? These are the two questions that are at the origin of the conference "System and freedom. Rationality and improvisation between philosophy, art and human practices". The conference, held on 28-31 January 2015 in the premises of the University of Turin and organized by the Center for Philosophical-religious Studies Luigi Pareyson, thanks to funding from the Piedmont Region, and with the sponsorship of the Interuniversity Center of Morphology Francesco Moiso, had a large (...) audience participation. There have been many reasons and reflections reported in this article, on the theme of improvisation and freedom, analyzed from a philosophical point of view. The very high quality of the speeches from the invited speakers and of all the speakers, the wide and lively public participation and certainly the intensity of the discussions contributed to the success of this long meeting. Esta pesquisa analisa alguns tópicos sobre a metodologia de acordo com a filosofia da ciência de Larry Laudan, além de examinar, na área da educação, esta proposta de interpretação filosófica. Trouxemos como elementos algumas considerações e definições sobre a metodologia em Laudan, isto é, da metodologia como um instrumento para a realização da axiologia (que são as metas e os valores cognitivos), porém, apresentando também interessantes relações para com as teorias específicas, como o de justificar as teorias específicas e de (...) ser restringida por elas. A metodologia é também, dentro do modelo reticulado de Laudan, justificada pela axiologia. Para além desta análise, há também uma defesa da metodologia enquanto o estudo dela própria, o que permite encontrarmos conexões interessantes em teorias da educação, como no caso da investigação-ação, onde vemos que estamos diante de uma tradição de pesquisa nos moldes defendidos pela filosofia da ciência de Laudan, por reconhecermos que temos um modelo reticular composto por teorias específicas, metodologias e axiologia também na área da educação. Veremos também que a metodologia em Laudan possui um caráter dinâmico, tensionando e sendo tensionada pelos componentes da tradição de pesquisa, caracterizando o modelo reticulado de racionalidade proposto pelo filósofo. Este debate em Laudan, juntamente com a tradição de pesquisa da investigação-ação da área da educação serão investigados neste artigo. Como base para a construção deste texto, utilizamos as seguintes obras de Laudan: The Progress and its problems: towards a theory of scientific growth (1977), Science and Values (1984a), Explaining the success of science: beyond epistemic realism and relativism (1984b), Methodology’s prospects (1986), Progress or Rationality? Many of Marco Aurelio Severino’s works were published in Germany, thanks to the intercession of his pupils. The prestigious Nürnberg physician Johann Georg Volkamer was Severino’s closest pupil. A relevant manuscript letter of Severino to Volkamer sheds new light on the context of the edition of Severino’s Zootomia democritaea. The correspondence between Severino and Volkamer was firstly studied by Luigi Amabile in the Ninteenth-century, and it was fully exploited by Maurizio Torrini about a century later.

A pesquisa tem como objetivo analisar aspectos/elementos da cosmologia de Aristóteles a partir da filosofia da ciência de Larry Laudan. A tentativa é apresentar neste artigo uma interpretação possível sobre o processo evolutivo da cosmologia da época sob o enfoque da filosofia de Laudan, baseado nas tradições de pesquisa, teorias específicas, modelo reticulado, progresso científico, metodologia, axiologia, etc. Abordaremos sobre a questão da aceitação das teorias específicas, a questão da eficácia na resolução de problemas, entre outras questões importantes para a (...) interpretação mencionada. O recorte histórico será importante enquanto elemento que permitiria visualizar esta interpretação filosófica e sobre como seria possível pensar em um modelo de reticulação neste contexto, na tentativa de apresentar os tensionamentos entre os componentes da tradição de pesquisa, como forma de destacar a necessidade de revisão constante destes elementos historicamente, dentro do processo evolutivo das tradições de pesquisa. Utilizaremos como base especialmente as obras O progresso e seus problemas: rumo a uma teoria do crescimento científico (2011) [1977] e Science and Values (1984). (shrink)

Neste artigo, propõe-se uma leitura das categorias no tratado aristotélico homônimo como um primeiro esboço de uma ontologia regional, centrada nas substâncias sensíveis. Tendo por foco substância, quantidade, qualidade, relativo, agir e sofrer, este trabalho busca expor as duas estratégias principais que Aristóteles parece empregar para chegar a uma lista das categorias: (a) características básicas, cuja satisfação ou não satisfação de cada uma determina a natureza categorial de cada item e (b) a propriedade única que caracteriza cada categoria em contraste (...) com todas as outras. São, então, feitas considerações para vincular esse primeiro esboço ontológico a temas discutidos nos livros Lambda e Zeta da Metafísica, de modo a sugerir as direções principais que a sua ontologia nova (e geral) seguirá ao evoluir para uma teoria unificada da substância. En el marco de los treinta años de la publicación en castellano de la segunda edición de la Teoría pura del derecho y de los setenta y cinco años de la primera publicación en alemán de dicha obra, del profesor austriaco Hans Kelsen, el Programa de Derecho de la Facultad de Relaciones Internacionales y Ciencias Jurídicas y Políticas de la Universidad de Bogotá Jorge Tadeo Lozano, celebró, en octubre de 2009, el Congreso Académico Internacional Hans Kelsen: una Teoría Pura (...) del Derecho, del cual se originó el libro que lleva el mismo nombre. La relevancia que produjo dicho evento en el ámbito académico, así como el interés despertado para la generación de un espacio similar con otros autores de importancia para la ciencia jurídica, se establecieron como el punto de encuentro y la razón de producción de aquello que lleva el nombre hoy de jornadas Académicas Internacionales de Argumentación y Filosofía del Derecho que, adicionalmente, sirvieron para una modulación de actividades desarrollas en el Foro de Interpretación, Argumentación y Decisión judicial del año 2010, llevado a cabo en nuestra Universidad, con presencia del profesor portugués Boaventura de Sousa Santos. Nel mio articolo propongo una lettura dei §§ 79-84 della Critica del Giudizio, parte della sezione Metodologia del Giudizio teleologico. Dapprima mi interrogo sul significato di una Methodenlehre del Giudizio teleologico, che rintraccio in un’attività metariflessiva del Giudizio; procedo poi ad una lettura analitica del testo nelle sue varie articolazioni, nella quale passo in rassegna le questioni attinenti alla specificità dello statuto epistemologico della teleologia, alla possibile convivenza tra finalismo e meccanicismo nella scienza della natura, all’origine della vita, allo scopo (...) ultimo della natura e allo scopo finale della creazione; approdo, infine, ad un’interpretazione per cui l’intera teleologia rationis humanae, che si estende dalla teleologia naturale alla teleologia morale passando per l’antropologia e per la filosofia della storia, viene in questa sezione riarticolata intorno ad un nuovo fulcro concettuale di livello trascendentale, che può garantire l’effettivo collegamento tra queste diverse parti della filosofia proprio perché esso non si esercita in forma di dominio legislativo, ma in forma di riflessione sul molteplice empirico e sulla causalità teleologica propria dell’uomo. The first part of this paper aims to highlight the analogies between Schutz’s vision of the natural attitude and Wittgenstein’s vision of a phenomenon that concerns the same problematic field, i.e. certainty, the belief of common sense that is free of all doubt, that the world “out there” is as it appears, absolutely real. These certainties form the basis, the foundation of language games and therefore of knowledge in general and in its entirety. This foundation is unfounded and yet indispensable. (...) The second part of the paper examines an important topic analysed by Wittgenstein, related to the aforementioned problem: the language transposition of pre-predicative, pre-reflective and non-propositional certainties, the cornerstones of which are “hinge propositions”, whose hybrid nature can be identified in the shift from empirical propositions to grammatical rules. This essay will discuss how the Theory of Communicative Action incorporates the systemic complexification process and the Systems and Life World duality. Part of this process will be carried out with the discussion of communicative action, as a space for dialogue between people seeking understanding. The process of new forms of understanding and construction of knowledge is possible through the integrative structure of the lifeworld, such as semantic dimension, social space, and historical time. However, there is the other side, the (...) Systems, where the manifestations of crisis and disturbances, the pathologies of society, which in cultural reproduction appear as a loss of meaning of culture, loss of legitimacy of society and in personality, there is a crisis of belonging. Simple assumptions represent a decisive reason to prefer one theory to another in everyday scientific praxis. But this praxis has little philosophical justification, since there exist many notions of simplicity, and those that can be defined precisely strongly depend on the language in which the theory is formulated. The language dependence is a natural feature—to some extent—but it is also believed to be a fatal problem, because, according to a common general argument, the simplicity of a theory is always trivial (...) in a suitably chosen language. But, this trivialization argument is typically either applied to toy-models of scientific theories or applied with little regard for the empirical content of the theory. This paper shows that the trivialization argument fails, when one considers realistic theories and requires their empirical content to be preserved . In fact, the concepts that enable a very simple formulation, are not necessarily measurable, in general. Moreover, the inspection of a theory describing a chaotic billiard shows that precisely those concepts that naturally make the theory extremely simple are provably not measurable. This suggests that—whenever a theory possesses sufficiently complex consequences—the constraint of measurability prevents too simple formulations in any language. This explains why the scientists often regard their assessments of simplicity as largely unambiguous. In order to reveal a cultural bias in the scientists’ assessment, one should explicitly identify different characterizations of simplicity of the assumptions that lead to different theory selections. General arguments are not sufficient. (shrink)
